Battlefieldsby4x4 TERMS & CONDITIONS Issue July 2016 1. Battlefields by 4x4 LLP (hereafter called Battlefieldsby4x4) is a Limited Liability Partnership (Registered in England and Wales - Reg OC398338) and all agreements entered into are done so, between the you the customer and Battlefields by 4x4 LLP , on that basis 2. Any agreement entered into between the customer and Battlefieldsby4x4 will be governed by English Law and both parties submit to the jurisdiction of the English Courts 3. Your booking is binding on receipt of the booking form, received electronically, with electronic confirmation provided to you by Battlefiedsby4x4 . 4. The customer making the booking accepts full responsibility for paying for all persons named on the booking and any inaccuracies are deemed to be your responsibility. 5. Battlefieldsby4x4 reserve the right not to proceed with any booking at any time. 6. Battlefieldsby4x4 will only use your details for their own purposes and the administration of your Tour . Battlefiedsby4x4 will not share your details with any third party, unless legally obliged to do so. 7. No booking can be accepted unless accompanied by a deposit as stated on the booking form. Payment of the outstanding balance is a minimum of 30 days before the start date of the Tour. 8. If the final balance is not made by the due date Battlefieldsby4x4 reserves the right to treat your booking as cancelled. Please note all deposits are non refundable 9. If you wish to cancel your Tour after your booking has been confirmed, you must inform Battlefieldsby4x4 in writing as soon as possible, electronically or otherwise. The date of cancellation is treated as the date it is received in writing. Battlefieldsby4x4 reserves the right to charge you a cancellation fee, as outlined in item 10. 10. The basis of any refund following a cancellation on your part will be that: a. Deposit Non refundable c. Between 59 and 30 days before the start date of the Tour 50% refund of balance d. 29 days or less before the start date of the Tour 0% refund of balance 11. No refunds for cancellations made on or after departure date can be given. You may be able to claim under the terms of your travel insurance and you should apply to them directly. 12. The customer making the booking accepts full responsibility to undertake that adequate vehicle insurance is in place for European travel and that personal travel insurance is held by all members named in the agreement. It is highly recommended that all members named in that agreement are in possession of a European Health Insurance Card (EHIC - previously E111), and that vehicles, passengers and contents are covered by a comprehensive recovery and repatriation policy in case of breakdown. 13. The customer making the booking accepts full responsibility to undertake that all members named in the agreement meet all Visa and Passport requirements for the countries visited with a Battlefieldsby4x4 Tour . Battlefieldsby4x4 accepts no responsibility if you or a member named in your agreement are delayed or cannot travel because you have not complied with any such Passport or Visa requirement. We are not liable for any cost incurred by you failing to meet these legal requirements. No refund or payments of any costs will be made under these circumstances. 14. Failure on your part to join the Tour at the agreed time and place will be considered by Battlefieldsby4x4 as a cancellation. No refund or payments of any costs will be made under these circumstances. If, for whatever reason, you are unable to meet us at the agreed time we do our best to meet you at an alternative time & location so that you can join the tour 15. During the Tour that you have booked you will visit Cemeteries and Memorials that are held in reverence by many. Should Battlefieldsby4x4 consider that the behaviour or demeanour of you or a member named in your agreement is unacceptable, upsetting or offensive, to other members of the Tour, or the Public, you will be asked to leave the Tour and will take no further part in the Tour. No refund or payments of any costs will be made under these circumstances. 16. During the Tour that you have booked you will be required to comply with all the prevailing legislation governing road laws at the time of the Tour. If Battlefieldsby4x4 consider that your driving is dangerous, unacceptable or annoying to other members of the Tour, or the Public, you will be asked to leave the Tour and will take no further part in the Tour. No refund or payments of any costs will be made under these circumstances. 17. The customer making the booking accepts full responsibility to undertake that at any point in the Tour, if requested to do so according to legislation governing road laws at the time of the Tour, the driver of the vehicle must be able to provide full documentation relating to the legal status of the vehicle and their permission to drive that vehicle. 18. The payment of any fines or costs relating to a contravention of legislation governing road laws at the time of the Tour are the responsibility of the driver. 19. The customer making the booking accepts full responsibility for their own and their passengers’ safety. Battlefieldsby4x4 cannot be held responsible for any loss, damage, accident or injury caused while partaking in a Tour 20. Battlefieldsby4x4 will make every effort to undertake special arrangements only as far as practicable and only based on information provided by you at the time of booking. 21. It is unlikely that Battlefieldsby4x4 will have to change Tour details during the running of the Tour, but sometimes changes are unavoidable. Any changes deemed necessary by Battlefieldsby4x4 will be made at our discretion for administrative reasons or in the overall interests of the Tour. Should you choose not to accept these changes you are at liberty to leave the Tour, which will be considered by Battlefieldsby4x4 as a cancellation. No refund or payments of any costs will be made under these circumstances. 22. As defined under English Law any Force Majeure will indemnify Battlefiedsby4x4 from all forms of refund, payment or compensation if Battlefieldsby4x4 cancel or change your Tour due to circumstances beyond our control and that could not have been foreseen or avoided 23. Rarely, we may need to cancel a tour because of reasons beyond our control or Battlefieldsby4x4 may consider that the number of bookings received does not meet the minimum required to operate the Tour outlined in your agreement. Under these circumstances Battlefieldsby4x4 will inform you of the cancellation, using the details provided by you at the time of booking, and offer you an alternative Tour or a full refund. As such, it is highly recommended that any crossing booked is a flexible ticket allowing date transfer or cancellation. 24. Battlefieldsby4x4 takes the safety and welfare of its customers very seriously. While driving and visiting the battlefields “duds” are often encountered. These shells, grenades, mortars and bullets are live ordnance. Such items still retain the ability to seriously maim and kill should they detonate. As such these items must be left untouched. Any member of the tour that collects or retrieves these items will be considered to have acted in a manner that has endangered the entire tour. Should this occur you and your party will be asked to leave the Tour and will take no further part in the Tour. No refund or payments of any costs will be made under these circumstances.
